T Visa for Labor Trafficking Victims by Rajat Shankar If you escaped labor trafficking in New York after someone used force, fraud, or coercion to control your work, federal law may offer relief through a T Visa. Under 22 U.S.C. § 7102, labor trafficking can involve involuntary servitude, peonage, debt bondage, or slavery, including threats, violence, confiscation of a passport, or pressure tied to immigration status. A T visa, created by Congress in October 2000 through the Victims of Trafficking and Violence Protection Act, can grant T nonimmigrant status for up to four years, allow work authorization, and open a path to a green card. Shankar & Associates PC 518 Plainview Rd, Plainview, NY 11803, United States (800) 461-1467 https://shankarlaw.com/new-york-t-vis... https://www.google.com/maps?cid=12579... Shankar & Associates PC supports trafficking survivors across Nassau County, Long Island, and throughout New York. Immigration attorney Rajat Shankar, Esq., admitted to the New York Bar, guides clients through USCIS requirements and prepares clear filings. The process commonly starts with Form I-914 (Application for T Nonimmigrant Status). Many applicants also file Form I-765 (Application for Employment Authorization) to request an Employment Authorization Document (EAD). If USCIS makes a bona fide determination under the modified process effective Aug. 28, 2024, the agency may grant deferred action and employment authorization while the case remains pending. USCIS encourages Form I-914, Supplement B (Declaration for Trafficking Victim) from Federal, State, Tribal, or local law enforcement, but USCIS can review any credible evidence. Your personal statement, police reports, court records, medical records, photographs, affidavits, and communications can help establish what happened. Minors under 18 and survivors who cannot cooperate because of physical or psychological trauma may qualify for exemptions to the law enforcement cooperation requirement. If an issue makes you inadmissible, you may request a waiver with Form I-192. Since Oct. 31, 2025, USCIS has routed T visa filings through the USCIS Lockbox rather than the Nebraska Service Center, so confirm the current address before mailing. New York law may also matter. New York Penal Law § 135.35 treats labor trafficking as a class D felony, and state-level actions can support a federal petition. The New York State Department of Labor, including the Division of Compliance and Education, may provide certifications in workplace trafficking situations. A T visa can also protect certain family members through Form I-914, Supplement A. Relatives abroad may complete Form DS-160 and attend a consular processing interview at a U.S. embassy or consulate. Later, T-1 holders may seek permanent residence by filing Form I-485 after three years or after a certified conclusion of the investigation, while following continuous physical presence rules. If travel becomes necessary, use Form I-131 for advance parole. If you face immediate danger, call 911. You can also contact the National Human Trafficking Hotline at 1-888-373-7888, text “HELP” to 233733 (BeFree), or call the HSI Tip Line at 866-347-2423.
