Shivkant Shukla (1976), also known as the Habeas Corpus case, was decided during the Emergency in India when the Supreme Court upheld the suspension of the right to life and liberty under Article 21, ruling 4–1 in favor of the State. The majority judgment, delivered by Chief Justice A.N. Ray and Justices M.H. Beg, Y.V. Chandrachud, and P.N. Bhagwati, declared that even habeas corpus petitions could not be entertained during an Emergency, sparking massive criticism for undermining fundamental rights. In contrast, Justice H.R. Khanna’s historic dissent affirmed that the right to life and liberty is inherent and cannot be suspended, making his opinion a cornerstone of Indian constitutional jurisprudence. The case is remembered as one of the darkest chapters in judicial history, later rectified by the 44th Constitutional Amendment, which protected Articles 20 and 21 even during Emergency, and was finally overturned in K.S. Puttaswamy v.
