The applicants have brought a constitutional challenge contesting sections of the Fugitive Offenders Act that were amended in 2009. They have also filed a judicial review application seeking to quash the Home Affairs Minister’s decision to issue the Authority to Proceed, to set aside the Authority to Proceed itself, and to invalidate everything flowing from it, including the arrest warrant and the committal proceedings before the Magistrates’ Court. In the judicial review, the Mohameds are further asking the court to permanently terminate the extradition process on grounds of alleged bias. The State opposed the applications, arguing that extradition is an executive, government-to-government process governed by the Fugitive Offenders Act, which provides its own framework for challenges and does not permit parallel litigation to derail ongoing committal proceedings. After hearing submissions from both sides today, Justice Singh directed attorneys to file their authorities by Monday and indicated that his ruling will be delivered on February 2 at 9:00 a.m.
