In this video John explains the use and origin of the UCMJ, Uniform Code of Military Justice. What is the UCMJ? The UCMJ or Uniform Code of Military Justice is the 101 of criminal procedure in the military, from investigation, charging phase, preliminary hearing or Article 32 hearing, the Court-Martial and everything in between. Whether Summary Court Martial, Special Court Martial, or General Court Martial. The UCMJ covers all aspects of military justice criminal procedure. The UCMJ has the A to Z of facing criminal justice in our military or steps to representing a service member in a military criminal justice action. As trial counsel or a prosecutor, it gives prosecutors the process to ensure the rights of victims and defendants are protected in military justice. The UCMJ has the Military Rules of Evidence, MRE, similar to the Federal Rules of Evidence that ensures only the appropriate evidence is admissible, in Article 32 procedures, Motions to Dismiss, Motions in Limine, and similar proceedings that mirror state and federal criminal motions. The UCMJ includes the criminal code as well or the criminal laws of the military, which is similar to Title 21 under Oklahoma law that covers Oklahoma criminal offenses. Everything in civilian criminal practice, such as Robbery, Murder, Larceny, and other state offenses are included in the UCMJ. However, the UCMJ also contains military specific offenses that relate to actions against Good Order and Discipline, against command directives, or other actions against military rules of professional conduct. These military specific offenses allow commanders to maintain control of service members. Additionally, the UCMJ includes a guide and script for judges to follow the appropriate process for military justice actions.
