DUI CHECKPOINTS DUI checkpoints – also called sobriety checkpoints – are temporary roadblocks in Colorado where police check drivers for DUI or DWAI. Here are five things to know: 1) Every motorist that goes through DUI checkpoints can get stopped and questioned. But only those who seem intoxicated get tested and possibly arrested. 2) The Colorado Department of Transportation posts advanced notice of upcoming sobriety checkpoints. Checkpoints usually pop up during times of high alcohol consumption, such as St. Patrick’s Day, July Fourth, New Year’s Eve, and Super Bowl Sunday. 3) DUI checkpoints are perfectly legal. Normally police need probable cause to stop a motorist. But since impaired driving is a public safety threat, DUI checkpoints are an exception to the probable cause rule. 4) Drivers who see a DUI roadblock in the distance have the right to turn around and avoid going through it as long as they do not violate any traffic laws in the process, such as making an improper turn or U-turn. 5) When you’re going through a DUI checkpoint, be polite to the officers. In many cases, as long as you’re not exhibiting any signs of impairment, they’ll just briefly question you and wave you through.
