Full interview with Immigration attorney Marlyn Moreno. Donald Trump announced he plans to carry out mass deportations during his time in office using local law enforcement, federal agencies and even the military. Law experts said using the military could bring a lot of challenges. Law Professor at St Mary’s University, Jeff Addicott says although the president does have authority to order mass deportations, using the military to directly carry out those orders can be much more complicated. “They just can't be directly used to arrest and detain individuals,” said Addicott. Addicott said a law passed in the 1800s restricts what active-duty military personnel can be used for. “The federal military cannot be used to enforce domestic law are used for domestic law enforcement,” said Addicott. However, Addicott said federal courts have ruled that military could be used in supportive roles, such as transportation, training and other processes. “If the president uses that authority and has the military operate in support functions, this would free up tens of thousands of federal agents, ICE agents to go out and make the arrest and do the detentions, and the military could do all the support and logistical functions,” said Addicott. Immigration experts tell us anyone who already has a removal order can be easily targeted and deported but if a migrant has been in the country for more than two years or is already going through the immigration process, deporting them could take a much longer time. “Have acquired a right to have an immigration judge hear their case to see if they’re eligible to stay under some section of the law so those people cannot just be uprooted and deported,” said Immigration attorney Marlyn Moreno. Moreno said the immigration court backlog is so long right now, having a removal order issued by a judge could take years. So long, Donald Trump may not be president anymore and immigration policies could have changed by then. Regardless of their circumstances, Moreno advises all migrants have an emergency plan. “Make arrangements. Make arrangements for the worst-case scenario. I don’t want to scare people, but we have to be realistic, there is a possibility that a lot of people could be deported in the next four years,” said Moreno. President-Elect Trump's mass deportation plan will require the help of police and sheriff's deputies. We reached out to the Bexar County Sheriff's Office for its stance. "There has been no communication from the federal government as to any new plans regarding immigration," a sheriff's office spokesman said in a statement. "The Bexar County Sheriff’s Office will continue to operate under our current policies and procedures."
