In 1976, the Hindu Marriage Act, 1955 was amended to provide for divorce through mutual consent (Section 13B). This provision requires that parties live separately for a year before presenting a petition for divorce and that parties take a minimum six-month ‘cooling off’ period before the decree of divorce could be granted. In the case of Amit Kumar vs Suman Beniwal , the Supreme court has observed that both parties have been married for about 15 months but have lived together only for 3 days and separated on account of differences.
