He soon found himself in the studio with Van Halen. They went through some songs with malloy recalling what eddie told him next ‘you’re the nicest guy i’ve ever met. So if you play me some music that I’m not attracted to … I just wasn’t hearing it. I didn’t get it. He didn’t play me anything that I was excited about except one song. And he seemed almost pissed off that I was excited about the one song. It was the one that sounded the most like older Van Halen.adding “Hmm. This guy isn’t hearing the new stuff.” And I wasn’t. I didn’t. I still don’t. I listened to Van Halen III once. I didn’t get it then and I don’t get it now. Another song that was given to Malloy was “It’s the Right Time,” He recalled ” It was a just really, really bad song. He’d written it with two amazingly talented people, Glen Ballard and Desmond Child. You would think that this is going to be an amazing song. Well, it wasn’t a good song; it was a bad song. And I was like, “Uh, OK. Yeah, sure.” He wanted to hear me on that song. So I recorded myself on that song. So there’s a recording of me singing on that song and, and Al singing backgrounds. It’s cool. Ed did let malloy know that they had recorded two new songs for a best of compilation coming out. Malloy admitted he wasn’t a fan of the songs to which Eddie responded “I’ve become a dentist,” Getting that vocal out of Roth was like pulling teeth.” And I was like, “Oh, OK. I get it. Eddie also opened up to malloy about his drinking and how he couldn’t write unless he was drinking. This was around the time leading up to the 1996 MTV Vivdoe music Awards where the band famously got up on stage with David Lee Roth. Malloy clarified that the members of van halen never told him they were going to get up on stage with Dave.By the time the VMA’s rolled around in September of 96, malloy had gone back homet o nashville, but he tuned into the program. Comedian Dennis Miller introduced van halen and much to malloy’s surprise the van halen brothers came on stage with David Lee Roth. Malloy was confused, what was dave doing on stage with van halen? To those in attendance that night and those watching at home, it seemed like the band was reuniting with Dave. Even malloy admitted to that he wanted Dave back in the band as a fan. Malloy claimed he was told by Van Halen’s camp that mtv told the band that if they wanted support from the network they would have to appear on state with Dave presenting the award for best new artist. On September 11, 1996 Mitch’s people send a letter to Van halen’s camp saying he was leaving the group. - he wanted to pursue his solo career in nashville, but also thanked them for the memories. Malloy got a frantic call from his friend hoffman who told him the band loved him and he shouldn’t have sent the letter. Rolling Stone reached out to van halen’s then manager Ray Daniels who told teh magazine ., confirmed that he received the letter — and that he didn’t realize until he saw it that Malloy had been left with the impression he had the gig.
