जाली कागजात की पहचान कैसे करें? Supreme Court Judgement Case: Vandana Jain & Ors. v. The State of Uttar Pradesh & Ors. Criminal Appeal No. 1127 of 2026 (Arising out of SLP (Crl.) No. 6670 of 2021) Date: 25 February 2026 Bench: Justice Pamidighantam Sri Narasimha & Justice Manoj Misra The Supreme Court quashed FIR alleging offences under Sections 406, 420, 467, 468, 471 IPC, including forgery of title-related document. WHEN IS A DOCUMENT LEGALLY “FORGED”? Forgery is defined through Section 463 IPC, read with Section 464 IPC. A document is considered forged only when: ✔ A false document is made AND ✔ It is made dishonestly or fraudulently AND ✔ It is made with intent to cause damage, support a claim, or commit fraud Under Section 464 IPC, a person makes a “false document” if: 1. He dishonestly makes/signs a document pretending to be someone else, or 2. He alters a document materially without authority, or 3. He causes someone to sign a document without understanding its contents 👉 Mere suspicion, administrative lapse, or missing record does not satisfy Section 464 IPC. Forgery requires active falsification, not passive irregularity. ________________________________________ WHAT DID THE SUPREME COURT HOLD IN THIS CASE? In Vandana Jain (2026), the allegation was: • A title-related document was forged • Government authority could not trace the record 11 years later The Supreme Court held: Mere inability of a public authority to trace a decade-old document does not establish that the document is false or forged. The Court clarified: • Absence of record ≠ Creation of false document • Suspicion ≠ Proof of dishonest execution • Record-keeping failure ≠ Criminal forgery This is extremely important because criminal liability under Sections 467/468 IPC requires proof of making a false document, not merely doubt about its existence. The Court essentially reinforced the evidentiary threshold for forgery. LEGAL POSITION ON FORGERY – SUPREME COURT PRECEDENTS The Supreme Court has repeatedly held that: (A) Civil dispute cannot be converted into forgery without proof of false document If the dispute is essentially civil and no ingredients of the criminal offence are made out, criminal proceedings should not continue. (B) Making a false claim ≠ Forgery Forgery is about fabrication of document — not about making a wrong claim under a document. The Court has consistently distinguished: • False claim under genuine document vs • Fabricated document itself Only the second attracts Sections 467/468 IPC. (C) Forgery Requires Mens Rea Dishonest or fraudulent intention must exist at the time of creation of the document. Without proof of: • Who fabricated it • How it was fabricated • Evidence of manipulation Forgery charge collapses. WHAT TO DO IF FALSE FORGERY CASE IS FILED AGAINST YOU? Based on Vandana Jain (2026): You may consider: ✔ Petition under Section 482 CrPC for quashing ✔ Argue absence of “false document” ingredient ✔ Show no material alteration ✔ Highlight delay in FIR ✔ Show dispute is civil in nature ✔ Demonstrate lack of forensic evidence If the allegation is merely: “Record not found” or “I believe it is forged” That alone is insufficient.
