Supp. 2d 1102 (2008) With the passage of the Compassionate Use Act in 1996, California became the first state to legalize medicinal marijuana. But the federal Controlled Substances Act continued to criminalize both medicinal and recreational marijuana. The conflicting statutes created a risk of mistaken belief that medicinal marijuana didn’t subject a Californian to any criminal liability. In United States versus Scarmazzo, we explore mistake of law as a defense to a criminal charge. Californians Luke Scarmazzo and Ricardo Montes operated a medical marijuana dispensary. They were charged with knowingly or intentionally manufacturing, distributing, dispensing, or possessing with intent to manufacture, distribute, or dispense a controlled substance in violation of the Controlled Substances Act. Among other things, Scarmazzo and Montes intended to assert mistake of law as a defense, arguing that they operated under a good-faith belief that their conduct was legal. In support, they intended to offer evidence of California’s legalization of medicinal marijuana and supposed advice from counsel regarding the legality of their conduct. The prosecution objected, arguing that mistake of law wasn’t a viable defense. The prosecution therefore filed a pretrial motion in limine in the district court where the case was pending, asking the court to rule that evidence related to mistake of law was inadmissible.
