(Feb. 16) [Notes:ANCHOR VOICE] Olympic gold medalist Michael Phelps will not face criminal charges. A South Carolina sheriff says he will not prosecute the swimmer after a photo released by a British newspaper showed him smoking from a marijuana pipe during a party last November . Authorities say they didn't have enough evidence to charge Phelps ... But say they charged seven others with simple marijuana possession. In a statement Phelps said he was glad to put the matter to rest and said he wouldn't make the same mistake again. [Notes:SOT Phelps from Feb. 6: "It's bad and stupid judgement ... and it's something I'll always live with ... and a lesson I'll always learn from."] Earlier this month... Kellogg said it would not renew its endorsement deal with him. And USA Swimming suspended Phelps for three months .... [Notes:SOT Phelps from Feb. 6: "It's something that USA Swimming came up with and ... you know ... it's fair. Obviously for mistakes you should get punished and they went and did that."] This isn't the first embarrassing episode for the swimmer. In 2004 ... an underage Phelps was arrested for drunken driving three months after the Athens Olympics. He pleaded guilty and apologized for the mistake. Phelps won a record eight gold medals in Beijing and returned to America as one of the world's most acclaimed athletes.
