As the FBI and Apple continue their high-profile legal arguments in the San Bernardino case, we are reminded that virtually all criminal investigations are impacted by device encryption. New mobile operating systems make it impossible for law enforcement with valid search warrants written for locked devices to access digital evidence. This makes it extremely difficult to build cases against perpetrators of all types of crimes including child sex abuse, homicide, sex trafficking, assault, stalking, domestic violence, and identity theft. State and local law enforcement, often with limited financial resources, are grappling with explaining to crime victims why encryption has caused them to hit a dead end in delivering justice.
