Q & A with Dr. Cindy Blackstock on Canada's Latest Litigation Tactics On Friday, December 2nd, 2022 at 2:00pm ET, I spoke to Dr. Cindy Blackstock from the Gitxsan First Nation, who currently heads the First Nations Child and Family Caring Society. She and her team at FNCFCS, their lawyers, and all the kids and allies who supported them, helped win the human rights case at the Canadian Human Rights Tribunal (CHRT) which found that Canada had racially discriminated against First Nations children in foster care. After many non-compliance orders against Canada, the CHRT awarded the impacted children and family members $40k each in compensation. Canada and the Assembly of First Nations (AFN), decided to negotiate a settlement agreement that included any class actions on child welfare and tried to make the CHRT compensation orders part of that settlement. However, the settlement agreement would exclude thousands of children who already won an award. While some First Nations passed resolutions supporting the settlement agreement, many others did not want it to go forward unless the children got there minimum $40k The CHRT did not approved the settlement agreement due to these and other concerns and suggested Canada & AFN renegotiate. Canada and the AFN expressed anger and disappointment and ultimately each filed judicial reviews of that decision in the hopes of having it overturned.
