The Public Safety Commission met on August 7, 2025 and received an update from Chief Wayne Mueller with the Regulatory Services Division. Chief Mueller explained three proposed rules to comply with legislative mandates from the passage of HB 46, which significantly expanded the Texas Compassionate Use Program. These proposed rules will be published in the Texas Register for public review and feedback. The Department must approve these rules by Oct. 1, 2025. The three rules relate to future licensing windows, security for satellite locations, and parameters for license revocation. Note: these new rules do not apply to the current application process, Aug. 8 - Sept. 15, 2025. In his general TCUP update, Chief Mueller provided details about the current application window and the two phased approach DPS will be using to review and approve new licenses. Pending applications from 2023 will be prioritized and evaluated applications. Nine new licenses will be issued by Dec. 1, 2025 and three additional licenses will be issued by April 1, 2026. Those who wish to withdraw their 2023 application will receive a refund of their application fee. Remaining applicants will be ranked based on criteria posted on the DPS website.
