He was a strong advocate for individual liberty and is best known for his observation on the dangers of putting tons of power and authority in a few people’s hands. We saw this exact thing happen with something called the New Deal. The New Deal was a group of federal programs in the 1930s that President Franklin D. Roosevelt or FDR pushed through in an attempt to revitalize the American economy post-Great Depression. Sounds harmless, right? Here’s the problem, that greatly expanded the federal government’s power. Power was centralized on politicians in Washington D.C. That threatened American liberty, business operations, and constitutional principles. The new deal reinterpreted and functionally redefined many of the clauses within the constitution. Because "Power is rarely taken openly; it is usually expanded through interpretation.” FDR threatened to pack the Supreme Court with new Supreme Court justices until he controlled it to force his redefinition of the constitution through the court system. Something no leader has ever threatened. He threatened to increase the court from 9 to 15 which would effectively install a communistic legal system. And after his threats, the Supreme Court suddenly flipped its position in 1937 and began to uphold New Deal programs. Power was taken by redefining definitions. By redefining the originally conserved ideas and laws you can develop a theology or legal framework that enables the power-hungry leaders to take actions the people end up supporting. If someone is forcing you to adopt a new definition. A new truth. That’s cause to wonder what is really true? Illegal alien or illegal immigrant to undocumented person Mother to birthing person Generosity to taxes Original meaning (Madison, Federalist 45): • Commerce = trade across state lines • Not manufacturing, farming, wages, or local business operations Post–New Deal meaning: • Commerce = anything that affects trade across state lines • That means literally almost everything in the economy This gave Congress authority over private business, agriculture, wages, working conditions, manufacturing, energy, etc. This is the single biggest federal power expansion in American history. It fundamentally shifted American governance by massively expanding executive branch power, transitioning it from a limited role to a dictator of the economy. How did these constitutional changes get passed? Constitutional change rarely happens through amendment. It happens through crisis, political pressure, and reinterpretation of the laws. FDR used: 1. Massive economic emergency 2. Popular support for quick action 3. Political dominance of Congress 4. Threats against the Supreme Court 5. Rapid creation of federal agencies This produced what the Founders feared most: A centralized national government justified by broad interpretations of “general welfare.” And the amendments were never used—because reinterpretation was faster. Washington State is in a level of concerning chaos. Citizens are constantly in a state of economic pressure. Rent is through the roof. Cost of living is enormous. They’re looking for quick action. A quick fix ASAP to fix cost of living and the horrible debt of our state. He’s beginning to push political dominance and threatening the legal system. Gov. Bob Ferguson is looking to impose a 9.9% state income tax. One of the most unpopular bills among the citizens ever presented in our state. Article 7 section 1 of Washington’s state constitution requires taxes on property to be equal. And the Supreme Court of Washington ruled income is defined as property. So the Governor is implying we completely ignore our state Constitution!! And again, the amendments were never used—because reinterpretation was faster.
