Rep. 402 (1842) The mailman was cruising down the road when the rental coach collapsed under him. Today he might’ve been able to sue the coach owner in tort, but back in 1842 England, the laws were different. The judges in Winterbottom versus Wright were much more interested in who had a contract with whom. The postmaster-general entered into a contract with Wright to supply coaches to deliver the mail. As part of the contract, Wright agreed to maintain the mail coaches in good shape. The postmaster-general entered into another contract with Nathaniel Atkinson to provide drivers and horses for mail delivery using Wright’s coaches. Winterbottom was a driver who worked for Atkinson. On August 8, 1840, Winterbottom was driving one of Wright’s coaches from Hartford , Chester County, to Holyhead. The coach had not in fact been maintained according to specifications and was dangerous to drive. The coach broke down due to this inadequate maintenance. Winterbottom was thrown from it and became injured for life. Winterbottom sued Wright in the Court of Exchequer. Winterbottom alleged that Wright’s negligent failure to perform his duty to maintain the coach was the cause of Winterbottom’s injuries. Winterbottom argued that Wright had entered into a contract with a public officer to supply a coach that was intended to be driven by a coachman and that, if it was improperly maintained, it would be dangerous to drive. A plaintiff injured by this negligence must have a remedy. Want more details on this case?
