This session, we discussed a recent federal court decision addressing EB-1 extraordinary ability petitions. This is the first decision to hold that USCIS impermissibly created and applied the EB-1A two-step / “final-merits” framework without proper notice and comment. While it doesn’t overhaul EB-1 adjudications entirely, it’s an important development and a helpful tool in navigating EB-1A filings and challenges. This session, we covered what the court actually held, what this decision does (and does not) change, and how it can be used strategically in EB-1 extraordinary ability cases. Key Moments: 00:00 - Introduction 02:38 - What is the EB-1A extraordinary ability classification, and describe what happened with it last month? 03:53 - Why is this court decision particularly significant, given that federal agencies like USCIS are sued all the time, even if it doesn’t formally change the EB-1A standard? 05:54 - Was the “final merits determination” not intended by Congress when it created the EB-1 extraordinary ability classification? 06:24 - Isn’t that actually USCIS doing applicants a favor by clearly laying out what extraordinary ability applicants need to show to get approved? 08:40 - If the two-step framework is still in place, what did the court’s decision in Mukherji v. Miller actually accomplish? ........................................................
