Essex Public International Law Lecture: International Adjudication in Times of Crisis The Essex Public International Law Lecture Series welcomes you to the latest instalment presented by Professor Marcelo Kohen and chaired by Emily Jones from the School of Law at the University of Essex. Abstract: We live in a time of crises in international relations at multiple levels. It suffices to mention the areas of peace and collective security, environment, health, and the economy. Responsibility for this situation is, in some cases, shared yet significantly differentiated. Instead of an international order based on the respect for rules, we are attesting to the deepening of a new international legal disorder, both concerning the compliance with rules and the functioning of institutions. In times of crises, it is normal to question the relevance of international law and institutions. Yet we should interrogate our concerns: are we witnessing the weakening of the international legal system? Or do crises rather reveal structural problem(s) of international law in an acute manner? Our responses to these questions point to very different perspectives on the value of the recourse to international adjudication. Adjudication could be seen as an important tool to state the law when urgently needed or, on the contrary, as a futile exercise; as a way to contribute to the solution of problems or as a device to conceal the incapacity to solve difficult situations. This lecture will address these questions to shed light on the possible uses and abuses of international courts and tribunals, as well as consider the task of the international judge and arbitrator in this critical context.
