On Day 4 of Florida v. Alicia Andrews, two witnesses testified about a shooting attempt on Julio Foolio eight months before his murder. The testimony connects the same suspects now charged in his death to a previous attack, and the State is using this pattern to build their conspiracy case against Alicia Andrews under Florida's principal theory. The question isn't just whether someone tried to kill Foolio before. The question is what this prior attempt proves about Alicia Andrews' knowledge, intent, and actions in June 2024 when he was finally killed. Alicia Andrews is not accused of being the shooter. She's not accused of being at the murder scene. She's charged under Florida's principal theory as someone who allegedly provided intelligence, tracking, and coordination that made the murder possible. The State must prove she had knowledge that a murder would occur, intent for it to happen, and took at least one action in furtherance of that plan. This testimony about a prior shooting attempt involving the same co-defendants is the State's way of showing this wasn't a spontaneous act. They're arguing this was an ongoing conspiracy with multiple attempts, and Alicia Andrews' text messages from 2021 expressing hostility toward Foolio prove she had knowledge dating back years. But here's the tension. Knowing that gang violence exists in Jacksonville doesn't prove you participated in a specific murder. Having animosity toward someone three years earlier doesn't prove you intended their death in 2024.
