After upholding the charges against Town Police Lieutenant Ryan Geiser, Board members Curtis Ward, Brooke Leffingwell, Aaron Leffingwell and Cathy Pelsor voted to recommend termination for Lieutenant Ryan Geiser on the first and second charges and recommended demotion to patrolman for the third charge. The final decision is up to the Brookville Town Council, who will be meeting on Dec 31 at 10:30am in the Franklin County Government Center. Shirley Seufert recused herself from the proceedings. COUNT I: Pursuant to Indiana Code §36-8-3-4(b)(2)(H), the investigation into Ryan Geiser's conduct as an officer of the Brookville Police Department has uncovered evidence that Ryan Geiser, while acting in an official capacity, has engaged in conduct unbecoming an officer in that his conduct has resulted in the Franklin County Prosecutor refusing to prosecute any cases in which Ryan Geiser is the investigating officer as set forth in the attached letter from the Franklin County Prosecutor, Christopher Huerkamp. Due to these actions, Officer Geiser's continued employment as an officer in the Brookville Police Department is detrimental to the discipline and/or efficiency of the Brookville Police Department. COUNT II: Pursuant to Indiana Code §36-8-3-4 (b)(2)(F), the investigation into Ryan Geiser's conduct as an officer of the Brookville Police Department has uncovered evidence that Ryan Geiser, while acting in an official capacity, has engaged in immoral conduct wherein he was not honest and forthcoming with the Franklin County Circuit Court 2 in his testimony during a hearing on a motion to suppress on July 19, 2022 in the case of State of Indiana v. Garrett Pierce, Case number 24C02-2202-F6-0095, and, in fact, lied under oath when under examination by the attorneys. Such acts directly affect his credibility and, combined with the refusal of the Franklin County Prosecutor to prosecute cases that Ryan Geiser investigates, renders his unfit and unable to discharge the duties of an officer of the Brookville Town Police Department. COUNT III: Pursuant to Indiana Code §36-8-3-4 (b)(2)(F and H), the investigation into Ryan Geiser's conduct as an officer of the Brookville Police Department has uncovered evidence that Ryan Geiser, while acting in an official capacity has engaged in both immoral conduct and conduct unbecoming an officer, wherein he ordered a subordinate officer, namely, Donald Forsee, to write a report that was intentionally misleading and contained false statements regarding the arrest on January 28, 2022 of Trevin Thalheimer over Forsee's objection and belief that this report was false and misleading. Forsee complied with the orders of a superior officer despite his objection. Due to these actions, Officer Geiser's continued employment as an officer in the Brookville Police Department is detrimental to the discipline and/or efficiency of the Brookville Police Department.
