That’s the line lawmakers in many places have drawn when it comes to firearm magazine capacity. But a court in Washington D.C. just took a hard look at that logic and ruled that the district’s ban on magazines holding more than ten rounds violates the Second Amendment. The court’s reasoning centered on one key word: common use. Millions of Americans own magazines capable of holding more than ten rounds, making them ubiquitous across the country. And under the Supreme Court’s Bruen decision, the government must show a historical tradition of banning something before restricting it under the Second Amendment. According to the court, there is no historical precedent for banning these magazines. Which raises a bigger question. If millions of Americans already own them, and there is no historical tradition of banning them… why were they banned in the first place? Supporters of magazine limits argue that limiting capacity makes firearms less dangerous. Critics argue the limits are completely arbitrary — and ultimately restrict the ability of law-abiding citizens to defend themselves. Because in real life, self-defense isn’t predictable. You don’t know how many attackers there will be. You don’t know how many shots you might miss under stress. And criminals certainly don’t limit themselves to ten rounds. So the real debate isn’t just about magazine capacity. It’s about whether the government should be able to arbitrarily decide how capable you’re allowed to be when defending your own life.
