To start, you need to gather the facts, including any evidence you have that you would present to the court. Often, you can provide a checklist showing any type of verbal, physical or emotional abuse and other altercations that may have occurred that warranted the protection order. Next, you proceed with an ex parte hearing with your verified complaint requesting a protection order, and the court will hear you on a temporary basis to issue a temporary protection order for a period of at least 14 days. Once you get that protection order, you need to make sure that you get the opposing party served, the protection order does not have any validity until the opposing party knows that they cannot have any contact with you. Service can be difficult. If you can't get service completed in the 14 day window, you will need to show up for court again and let the court know that you've had difficulty obtaining service and that you needed continuance of an additional 14 days. Statutorily, the court can provide you a 14 day continuance when good cause is shown. Likewise, once you get the party served, and you have a permanent protection order hearing set, you'll appear in court with your witnesses, your questions and your evidence - make sure you bring multiple copies of any exhibits that you intend to bring to the court. If you need additional time to prepare your exhibits, or to subpoena witnesses to appear at the hearing, you will need to request a continuance. At that hearing, the court will determine either by agreement of the parties or by determination after a hearing whether to make the protection order permanent. Alternatively, you can agree to extend a temporary protection order for a period of up to one year or the length of a dissolution of marriage case, whichever is longer.
