Public Prosecutor | 1 W.L.R. 965 (1956) Hearsay is excluded from evidence because it’s considered unreliable. But to count as hearsay, a statement must be offered to prove the truth of its contents. If an out-of-court statement is offered for a different reason, it might not be hearsay at all, as the court explains in Subramaniam versus Public Prosecutor. In April of 1956, four members of the security forces of the Federation of Malaya went to search a terrorist camp in Johore state. They found the camp empty, but in searching the surrounding area they discovered Subramaniam, who was wounded. Subramaniam didn’t have a weapon, but he was wearing an ammunition belt that contained twenty rounds. Subramaniam was arrested and charged with carrying ammunition, which at the time was a crime punishable by death. He pleaded duress as a defense, maintaining that he’d been captured by terrorists, who forced him to carry the ammunition. The trial court, the High Court of Johore Bahru, refused to allow Subramaniam to testify about what the terrorists told him, excluding evidence of conversations between Subramaniam and the terrorists as hearsay. At the close of the trial, the trial court concluded that there was no evidence that Subramaniam had been acting under duress and convicted him. The Supreme Court of the Federation of Malaya dismissed Subramaniam’s appeal. Subramaniam appealed to the Judicial Committee of the Privy Council. Want more details on this case?
