The arrest of Aryan Khan, son of Bollywood superstar Shah Rukh Khan, in the Mumbai cruise drug case in October 2021 became one of the most talked-about legal and media events in India. What initially looked like a routine narcotics investigation soon turned into a high-profile courtroom battle that drew national attention. Aryan Khan was detained by the Narcotics Control Bureau (NCB) after a raid on a cruise ship off the Mumbai coast. The agency alleged that drugs were being consumed and trafficked during the party onboard. Aryan was accused of being part of a conspiracy related to possession and consumption of narcotics. His arrest immediately triggered massive media coverage and public debate. In the initial phase, Aryan’s legal team approached lower courts seeking bail. However, the process proved difficult. Several lawyers attempted to secure his release, but the magistrate court and later the special NDPS court rejected the bail pleas. The courts accepted the NCB’s argument that the case involved a larger conspiracy and that custodial interrogation was required. This led to Aryan spending several days in Arthur Road Jail while the case proceedings continued. With no relief from the lower courts, the matter was taken to the Bombay High Court. This is where Aryan Khan’s legal strategy took a significant turn. Senior advocate and former Attorney General of India Mukul Rohatgi was brought in to lead the defense, supported by a strong and experienced legal team. Rohatgi’s entry changed the pace and direction of the case. Before the High Court, Rohatgi and his team strongly argued that no drugs were recovered from Aryan Khan’s possession. They maintained that mere presence at a party cannot be treated as a crime under the NDPS Act. The defense also questioned the NCB’s reliance on WhatsApp chats and the conspiracy angle, stating that the agency had failed to establish any direct link between Aryan and drug trafficking or consumption. The legal team further highlighted that Aryan had cooperated with the investigation and that there was no risk of him tampering with evidence. They emphasized that the prosecution’s case was based more on assumptions than concrete proof. These arguments were presented over multiple hearings, during which the High Court carefully examined the evidence and the legal interpretation of the charges. After hearing both sides, the Bombay High Court granted bail to Aryan Khan. The court observed that there was no prima facie material to show Aryan’s involvement in possession or consumption of drugs. It also noted that the NCB had not conducted any recovery from him and that the conspiracy allegation was weak at that stage. Aryan’s release was seen as a major relief for Shah Rukh Khan and his family after weeks of emotional and public pressure. The case also sparked larger conversations about media trials, celebrity scrutiny, and the interpretation of narcotics laws in India. Even years later, the Aryan Khan cruise drug case remains an example of how legal strategy, strong advocacy, and judicial scrutiny can shift the course of a high-profile investigation. Mukul Rohatgi’s entry into the case and the detailed arguments in the Bombay High Court ultimately played a decisive role in securing Aryan Khan’s bail.
