When assessing the recent popularity in alternate cannabinoids produced from hemp , and the legal loophole surrounding THCA, the DEA seemed to solidify its stance that almost any compound outside of CBD is seemingly a threat to the public and considered a controlled substance. It affirms the opinion that D9 -THCA is equivalent to D9-THC which the DEA views as a controlled substance and hemp may not contain more than .3% of such substance. They state that when evaluating the legality of hemp products post decarboxylation testing must be used, which is not the type of testing mandated under the 2018 farm bill. This type of testing can make even harmless and un intoxicating hemp products appear over the legal limit and declared "marijuana". What is your opinion on the DEAs stance on THCA and other cannabinoids ? As many of you know the DEAs stance in merely their agency's opinion on the written laws, as they have no legal authority to ban anything alone.
