The powers of the FREC are limited to administrative matters and do not extend to criminal actions. The FREC may not impose imprisonment as a penalty. The primary purpose of the administrative jurisdiction granted to the Commission is to enforce duties and obligations as they apply to individuals and firms actively engaged in the real estate business. The Commission makes decisions and sets policies that are carried out by the Division of Real Estate (DRE).
