One of the most complex issues that confront a society based on the rule of law is: what should be done when the State breaches a law in the exercise of its governmental functions? Further acts may follow on the unlawful conduct and it may cause chaos treating illegal acts as if they never occurred. The Oudekraal judgment established the principle that an illegal act has consequences and remains in place until set aside. The principle has given rise to anomalies especially where the State seeks the review and setting aside of its own illegal acts and requires reappraisal and perhaps recalibration.
