The horror and sheer depravity of the rape and murder of Asifa Bano, an eight-year-old girl in Rasana village of Kathua district in Jammu, has left the nation sickened. In a country where rapes, even rapes of minors, tend to be seen as ‘tragic incidents’ that are quickly ‘normalised’, the gruesome and calculated violence wrought on this young girl is paralysing. And yet, while the disturbing consequences of politicising the crime is played out along familiar lines, another strand of outrage is picking up traction: that of Asifa being identified by name and face in the media. This demand for Asifa’s anonymity is not only pointless, but is an unwanted digression that takes the focus away from the real horror and the need to bring those responsible for it to justice. The 2012 Delhi rape case ultimately saw gangrape victim Jyoti Singh’s parents wanting their daughter to be remembered by more than the emblematic tag of ‘Nirbhaya’. In 2013, rape survivor Suzette Jordan decided to step out of her media description as Kolkata’s “Park Street rape victim”, seeking not only to ‘reclaim her life’ but also to underline the fact that it was her assailants, not she, who needed to be ashamed. Asifa Bano was too young to understand all this. In any case, she is dead. To not tell the world that she was a flesh and blood child with a name will not only be a travesty, but also add to those voices bent on making her ‘case’ one among far too many others. The anonymity of a victim of a sexual offence is protected by law. Section 228A of the Indian Penal Code (IPS) prohibits any disclosure of details that could reveal the identity of a sexual assault survivor, unless the survivor herself decides to disclose them. Section 228A also lets the next of kin of a victim disclose her identity if she is deceased or of ‘unsound mind’. The desire for anonymity is understandable. But Asifa did not survive the butchery unleashed on her. Demanding her identity not only serves no purpose—apart from theoretical self-righteousness— but muffles the horror and the seriousness of the crime. Depersonalising Asifa depersonalises the brutal crime committed.
