FCRA stands for Foreign Contribution Regulation Act….Any charitable organization, such as a trust, society, or Section 8 Company incorporated under the Companies Act of 2013, that wishes to receive funds or donations from foreign entities or resources must register under the FCRA, 2010. Section 6 of the act mentions that any organization having a definite cultural, social,Educational, Religious,or Economic motivescan accept foreign donations only after obtaining FCRA Registration. In India to obtain this FCRA registration, the applicant must be able to fulfill all eligibility criteria…. Organizations seeking foreign donations for specific cultural, social, economic, educational, or religious programs can apply for FCRA registration or use the "prior approval" procedure to receive foreign contributions. An FCRA applicant should preferably be a Trust, Society, or Section 8 Company. The not-for-profit organization must have been in operation for at least three years before filing the FCRA application, and it must not have accepted any foreign contributions without prior approval from the government. In addition, the entity seeking registration must have spent at least Rs.10,000/- on its aims and objectives in the previous three years, excluding administrative costs. Statements of Income and Expenditure for the last three years, thoroughly audited by a Chartered Accountant, must be submitted to substantiate that it fits the requirements.In case a newly registered entity would like to receive foreign contributions, then approval for a specific activity, specific purpose, and from a specific source can be made to the Ministry of Home Affairs through the Prior Permission (PP) method. The main purpose of this FCRA, 2010 is to 1. Control the use and acceptance of foreign contributions or hospitality by specific organizations or corporations. 2. The prohibition of the use and acceptance of foreign hospitality or contribution to activities that are not favorable to national security and any matters connected to them or in connection with.
