Carrnshimba | 215 Cal. App. 4th 1068 (2013) In City of Monterey versus Carrnshimba, we’ll see whether a marijuana dispensary could be deemed a public nuisance under a city’s zoning laws. In December of 2009, Jhonrico Carrnshimba opened a medical marijuana dispensary in Monterey, California. Carrnshimba’s dispensary was located within the city’s C-2 commercial zoning district. Under the Monterey city code, the C-2 district was zoned for retail businesses and commercial establishments. The city code outlined 50 specific types of businesses and categories of businesses that could operate in the C-2 district. However, marijuana dispensaries were not listed as a permissible business that could operate in the district. In January of 2010, after the city learned that Carrnshimba was operating a dispensary, the city informed Carrnshimba that he needed to immediately cease and desist operating the dispensary. 8 days later, the city enacted an ordinance that specifically prohibited any marijuana dispensaries from operating within the city. The city then sued Carrnshimba to shut down the dispensary, claiming that it was a public nuisance. The trial court granted summary judgment in favor of the city and issued a permanent injunction against Carrnshimba’s dispensary based on the ordinance that Monterey enacted in January. Carrnshimba appealed to the California Court of Appeal. Among other claims, Carrnshimba argued that Monterey’s city code was discriminatory and that the moratorium couldn’t be applied retroactively because it was adopted after Carrnshimba’s dispensary was in operation.
