Well the answer to that question is it depends. You cannot move the child out of the state of Colorado unless you have either the permission of the other party or a court order authorizing you to move. Relocation cases are some of the most litigated cases that we have here in our court system. People want to move outside of Colorado for a lot of different reasons. A lot of people come to me and say they simply can't afford to continue living here that's just too expensive, but the problem is if the other parent objects to you moving with the child then you're going to have to file a motion with the court and get court permission to move. That process can be very emotional, and it can also be fairly costly because they usually go to a contested hearing. It's very difficult to come up with a parenting plan that addresses someone moving out of state with the child. If you do think you want to relocate with your child, please come in and talk to me. I can give you some honest and straightforward advice as to your chances of being able to move out of the state with your child. What it could potentially cost and whether there's a parenting plan that you can come up with that would allow you to move. So, a relocation case is something that I don't recommend you handle on your own. Come and see me we can talk about it and decide what is the best strategy for you moving forward.
