Olia Catala an immigration attorney from the firm of Catala Marques, PLLC explaining the Final Rule on Public Charge Ground of Inadmissibility which will go into effect on October 15, 2019. This is a summary of the changes for all those who are worried about how the rule will affect their immigration status. *** Please note some immigrants with be exempt from the public charge determination. These immigrants include the following: refugees; asylees; survivors of trafficking, domestic violence, or other serious crimes (T or U visa applicants/holders); VAWA self-petitioners; special immigrant juveniles; and certain people paroled into the U.S. Benefits received when people are in one of these statuses will not be counted against them. And lawful permanent residents (people with green cards) are not subject to a public charge test when they apply for U.S. citizenship.
