By definition, a felony is a crime for which the maximum sentence is more than a year in jail or prison. If the maximum sentence is a year or less of custody time, then the crime is only a misdemeanor. Felonies tend to be more serious crimes such as murder, rape, robbery, sales of narcotics, and grand theft of larger amounts of money or property. Some crimes are what we call wobblers, meaning they can be charged as a felony or a misdemeanor defending on the circumstances.
