Brian Walshe was guaranteed a sentence of life in prison without parole when a jury convicted him of first-degree murder on Monday, but the judge had discretion on how to sentence him for his other crimes of lying to investigators and failing to convey a body. Assistant District Attorney Greg Connor in Norfolk County, Massachusetts, recommended Walshe be sentenced to three additional years in prison for failing to convey his wife's body and 19 additional years for lying to investigators. Walshe's lawyers said the consecutive sentences violated the U.S. Constitution's Eighth Amendment prohibition against cruel and unusual punishment. 01:04 "The defendant did not just the person that he illegally conveyed was his his wife and the mother of his three children, and he did it by removing her remains from the family home and placing them in buckets and garbage bags and dumpsters around the Commonwealth. He denied, as you just heard, her family, the opportunity to have any customs or burial. There is no grave, there is no memorial. And he did this all in an effort to destroy evidence on the misleading component." 03:23 "It is data that you can use in order to determine the scope of his lies in which the police relied on them, and you can see the cost that went into investigating the disappearance of Ana Walshe." 05:39 "They say the Commonwealth's recommendation is inhumane. I suggest that's not the appropriate word choice, because if we were to look at that word, I would suggest that that describes the defendant's actions and the depravity of his actions, of murdering his wife, dismembering her and getting rid of her remains by throwing her away like garbage." 07:45 "I think inhumane is the right word," Walshe's lawyer Kelli Porgess said 11:42 "There is no task facing a judge that is more important or more difficult than crafting an appropriate sentence," Norfolk County Superior Court Judge Diane Cabo Freniere said Walshe will serve his life sentence at the same time as his 37-month federal prison sentence for a fraud case related to counterfeit Andy Warhol paintings. He was on home confinement awaiting sentencing in the case when he murdered his wife, who was seeing another man after taking a new job in commercial real estate in Washington, D.C. ****************************************************************************** Become a member of Meghann's YouTube channel to show your support: / @meghanncuniff Subscribe to Legal Affairs and Trials with Meghann Cuniff: https://www.legalaffairsandtrials.com...
