Every year as the time comes to issue T4 forms I revisit the conversation about subcontractors or employees? Employees will receive a T4 form, complete with deductions for EI, CPP and income tax. A subcontractor gets a T4A with no deductions. How do you decide? If you have a person who comes to your place of business when you ask them to, they work with your materials, use your tools and they go home when you let them. This person is generally considered to be an employee. Let’s talk about an electrician as an example. The helper who follows the electrician around and fetches stuff from the truck is an employee. If the electrician gets busy and needs more help, she could hire another electrician to do some of her work. She could, for example ask another electrician to wire a newly constructed home and give her the invoice when they are done. That is a sub-contractor.
