Episode #22 – Richard, Paul, and a special guest Dr. Karen Lundy discuss the topic of time limits at the WSIB and its impact on injured workers. Currently the WSIB has two time limits 30 days for return to work and six months for all other matters. The decision I was referring to where I was the injured worker’s paralegal. I had successfully appealed to the WSIAT, the WSIB’s ARO’s decision. The ARO denied my client’s request to extend time based solely on the issue that the injured worker had far exceeded the time limit to file an appeal of six months. The delay was more than 10 years. However, the WSIAT Vice-Chair felt time was not a barrier, based on other factors, and in the interest of justice the delay of ten years was justified.
