We represent victims of motor vehicle accidents, other types of accidents and a hit and run accident. However, there's a few things you need to know. First, it's just like any other accident. Get medical attention, get pictures, get any witnesses, witness statements, talk to the police, whatever you can do at the scene. If you're badly injured, you can't do much of that. Usually, in most cases, it's not a hit and run, and we get the information regarding the other party. If it is a hit and run, and nobody can come up with the name, address, license plate of the vehicle that caused the accident, you have a recourse. Absolutely have a recourse in Massachusetts. It's called Uninsured cases on your insurance policy, you have what's called you coverage underinsured and uninsured coverage. Someone that's underinsured means that you have a serious injury, but the other side doesn't have enough coverage. For a hit and run, it's uninsured. They're not insured. It could possibly be that they actually stop and say, Hey, I'm sorry, here's my name and address, but I have no insurance. But in a hit and run context. They simply leave and you can go on the uninsured portion of your insurance policy. The minimum for that is $20,000, but it goes up depending upon what coverage you bought. You don't file suit in court in those instances. You file a complaint for arbitration and it doesn't go through the court system. It goes through an arbitration system and frequently can be settled. Especially if you're, if the liability is clear. The other party clearly caused the accident and your injuries are clear. But, and this is against your own insurance company, but you need an attorney, your insurance company, even though they're obligated to pay what they're obligated to pay. They figure out ways to not pay, that's their job or pay a minimal or make a minimal offer. You have to be aggressive and effective. You have to get the medical records, the lost earnings information to them. You have to show it to them in a way that makes sense to them. If you have a permanent injury, you need to get an expert witness, a doctor that can show the permanent injuries by his or her written report that says that you have a permanent injury. The insurance company, even if you are missing a finger, they're not going to necessarily say that that's permanent. They're going to say, well, we're going to give you X amount of dollars, but we don't know how that's going to affect you. But maybe it's a critical finger. Maybe it's a critical body part that doesn't function the way it used to. These are serious cases, and the insurance companies will do everything they can to pay a minimum.
