Being in possession of marijuana can be a federal crime under certain circumstances. So for instance, federal law does prohibit somebody being in possession of marijuana with the intent to deliver it to another. Federal law also prohibits somebody from manufacturing marijuana, but under a federal law the quantities of marijuana are going to be much higher and the penalties are much higher, but in general the federal law enforcement have enforcement priorities, and the Department of Justice has clearly stated that they are not going to pursue any criminal prosecutions or criminal investigations regarding marijuana if that marijuana is within the state's marijuana laws. So in Michigan we have medical marijuana laws, and as long as somebody is operating within our Medical Marijuana Act the Department of Justice has stated that they are not going to pursue any type of criminal prosecution, but what they do pursue are large scale marijuana trafficking and large scale marijuana possession.
