Welcome to the outrageous true story of Roger Smith — an East London attorney who bought Wembley Farm in 1985, only to be forced into selling it in 1999 when Buffalo City Municipality said they needed it for a cemetery. But the cemetery was never built. Instead, the land was abandoned, vandalised, and left to decay. Smith fought back — and after nearly two decades of court battles, stalled settlements, and a mountain of legal fees, he finally won. The court ruled that the municipality had no right to keep the land, slapped them with a punitive costs order, and exposed the lies and incompetence of their municipal manager. But here’s the kicker: this happened before the Expropriation Act of 2024. Under the new law, government can now seize land with nil compensation — without waiting for a court ruling. The list of reasons for taking land is vague, easily manipulated, and open-ended. They can declare your land “underutilised” or “not in the public interest,” and just take it — leaving you to fight for years, if not decades, to reclaim it.
