Getting off to an early start this morning to address the Commonwealth's motion to exclude a defense expert, alleging the expert was not timely disclosed. After the motion is resolved, we'll be continuing with the cross-examination of MSP Sgt. Yuriy Bukhenik, one of the primary investigators on the case along with Trooper Michael Proctor. So far, cross-examination of Sgt. Proctor has elicited some very helpful facts for the defense, including (1) There is no evidence that Karen Read ever accessed John O'Keefe's Ring camera system (despite insinuations from the prosecution that she deleted incriminating videos); (2) Sgt. Bukhenik initially advised the medical examiner that John may have been hit in the face with a cocktail glass; (3) Sgt. Bukhenik's timeline of when Brian Albert arrived at the McCabes's house differed from theirs; (4) Neither Sgt. Bukhenik or Trooper Proctor went to the scene for several days after the incident; (5) John's clothing was not booked into evidence for six days after it was recovered from the hospital; (5) Sgt. Bukhenik believed that Canton Police Department had only recused itself from the interview portion of the investigation due to Brian Albert's brother, Kevin Albert, being a Canton police officer; (6) John's Ring camera shows Karen's car striking John's car with the area near her passenger taillight when she pulled out of the driveway at about 5 a.m., causing John's car to move; and (7) The sallyport video showing Karen's car being pulled into the garage is mirrored, so that what appeared to be the passenger side on direct examination is actually the driver's side. There are also numerous points where the video skips, which Sgt. Bukhenik explained as a fog of some sort. When we concluded for the day, Alan Jackson had just had a thumb drive marked for identification but Judge Bev was not allowing him to play a portion to see if Sgt. Bukhenik could identify it. We'll see if the thumb drive is revisited or if Mr. Jackson finds an alternative way to present the evidence.
