As the bill was handed to the city’s Legislative Council for consideration, some lawmakers raised concerns about whether fair trials could be assured on the mainland, and if political fugitives could be transferred under extradition requests citing fabricated information. The Hong Kong government has stressed that before any extraditions its Department of Justice would consider on a case-by-case basis whether requests have religious, racial or political motives – including hidden motivations. The bill was proposed after a loophole was exposed following a Taiwanese murder case. In the case, a Hong Kong suspect accused of killing his girlfriend in Taiwan could not be extradited to the island to face trial due to a lack of an extradition agreement between Hong Kong and Taiwan.
