Brandon Naidu: Hi there. My name is Brandon Naidu. I'm a criminal defense and DUI attorney in San Diego, California. DUI is one of the most common and one of the scariest crimes to be charged within California. The reason for that is California is one of the toughest states on DUIs. The first thing you need to know about a DUI is that you have a very limited amount of time to protect your driver's license; 10 days from the date of arrest for DUI. Most likely you have been given what we call the pink sheet. That's a DMV form, which has a huge paragraph with very fine point lettering on it. Most people don't read it, but if you do, you'll realize I only have 10 days to be able to stop the automatic suspension on your driver's license. Why is that important? California says that driving is a privilege, but for our clients, it's a right. It's part of your livelihood. It's how you get to and from work. It's how you pick up the kids from school. It's how you run grocery errands, everything for the family. So for our clients, the license is the most important aspect that needs to be protected. The next question that we're constantly asked is, "Okay, you've stopped the automatic suspension, but will my license be suspended? Or what if I refuse the chemical test? I read online that I'm going to lose my license for a year." Well maybe. It depends. If the officer's accusing you of refusing the chemical test, the question is, was it a valid refusal? Was this one where you flat out said, "I'm not taking this test?" Or is it something where ... we get this very commonly ... the breathalyzer was not working properly. You were blowing, but it wasn't registering. The officer, he gets kind of frustrated and he just says, "Well, I don't think that this is working out very well. I think you're refusing. I think you're trying to cheat the test." Right there, that gives us something that we can argue against that this is not an actual refusal and protect your license from that hard automatic one-year suspension. So for a lot of our clients, again, the license is the most important aspect. What about, "Hey Brandon, I missed the 10 days before I gave your office a call. Am I out of options?" No, not necessarily. There are many options, depending on your driving record. We go through all of that. We'll get a full copy of your driving record and we will be able to look through what your options are. In most cases, we can get a full driving privilege restored very quickly, as long as certain conditions are met.
