Although the judge discharged him without conviction due to the context — he wore it during a funeral — the patch was still forfeited under the law. Now, Te Rata is asking for the patch to be returned, arguing it holds deep symbolic value. His lawyer says the law’s wording, allowing items to be “otherwise disposed of,” gives judges the discretion to return patches in exceptional cases. But police argue this would go against the law’s purpose. Legal experts say the law is open to interpretation and Parliament didn’t clearly rule out the return of patches. A similar case in Palmerston North may also test this clause. Since district court rulings aren't binding, future High Court decisions may be needed to clarify whether gang patches can ever be returned after minor breaches. For now, it’s up to individual judges to decide — and their rulings could shape how the law is applied moving forward.
