Lacy Investment Corp. | 379 S.E.2d 519 Halpern versus Lacy Investment explores the fine line between adverse possession and plain old trespass. In 1960, Shirley Halpern and her husband built a house on a lot they owned. There was a large, empty property behind the Halperns’ lot. Mr. Halpern approached the owner of this land and asked if he could purchase it. The owner refused to sell. The Halperns bulldozed and cleared the property anyway and included it in their yard. Shirley Halpern, now widowed, was still using the land she didn’t own in the 1980s. By this time, Lacy Investment Corporation owned the parcel that the Halperns had incorporated. Halpern brought a claim of adverse possession, seeking to quiet title to the land. Lacy counterclaimed for trespass and slander of title. The trial judge instructed the jury that a good-faith claim of right could be shown by evidence of acts relating to the property that are inconsistent with the true owner’s title. He declined, however, to give the instruction Halpern requested that hostile possession is a legal equivalent of claim of right. The jury found that Halpern hadn’t acted under a good-faith claim of right and denied her claim. Halpern appealed to the Georgia Supreme Court. She argued that she could meet the claim-of-right requirement for adverse possession by showing hostile possession, with no need to show good faith. Want more details on this case?
