The Transgender Persons (Protection of Rights) Amendment Bill 2026 has introduced a major shift in how gender identity is recognized in India. Earlier, following the landmark NALSA Judgment (2014) by the Supreme Court, gender identity was considered a matter of self-identification, directly linked to dignity and personal freedom. But under the new amendment: • Self-perceived identity may no longer be sufficient • A medical or administrative board may decide recognition • The process becomes institutional rather than personal This raises a deeper question: 👉 Can identity be verified by the state? 👉 Or is identity something only an individual can define? Globally, many countries like Argentina, Ireland, Malta, Nepal and Pakistan follow a self-declaration model, where individuals define their own gender identity. This video is not about taking sides — It is about understanding the shift: From self-identity → state validation Because at the core, this is not just a legal issue.
