Adoption of AI technologies in the construction industry is at an early stage, and the level of adoption varies across the industry. Yet AI will be increasingly integrated into different business processes. Some might even claim that not using AI for certain tasks is irresponsible. Given the rapidly evolving landscape of AI applications and industries, unforeseen issues might arise and potentially lead to legal disputes. It is typically a contractual requirement for contractors and consultants to exercise reasonable skill and care when providing their services. This duty is fulfilled by acting in accordance with industry good practice and professional standards. As industry guidance is not well established for using AI across the supply chain for different uses, and technology will likely advance ahead of court decisions, questions will arise such as what standard of care is required when using generative AI in construction, or how to evidence that reasonable skill and care has been adopted in the implementation of AI technologies. This webinar brought together legal experts for a panel discussion on reasonable skill and care when using AI in construction to inform the industry about and discuss current thinking on the challenges ahead.
