Lrs. on 29 January 2019. In this judgment, the court has clearly said that- If someone has occupied your house or land, then you can get it vacated without going to court. In Poona Ram vs Moti Ram case, the Supreme Court said that if you have the title of the property, you can vacate the property by force even after 12 years. There is no need to file a case in court for this. And if you do not have the title of the property and it has been 12 years since the possession, then you will have to file a case in court. The Specific Relief Act 1963 has been made for the legal proceedings of such cases. According to Section 5 of the Specific Relief Act, if a property is in your name i.e. the title of that property is with you and someone has illegally occupied that property, then a case can be filed under the Civil Procedure Code (CPC) to vacate it. The Supreme Court rejected has passed the judgment and said that this law is applicable in those cases, no one is the owner of the land, but if the land is owned by someone and has the title of that land, then it can be forcefully vacated even after 12 years.
