The government does not help a green card holder secure financial support under the Form I-864 Affidavit of Support. The only way an immigrant can force an I-864 sponsor to provide financial support is through a private lawsuit. The government has no legal authority to sue the sponsor on behalf of the immigrant. However, the law does give the green card holder the right to recover attorney fees and costs from her sponsor, so the sponsor has to pay for the expense of a successful lawsuit against them. The government has the ability to sue the sponsor only when it comes to the obligation to repay federally-funded benefits like Medicaid, TANF (cash benefits) and SNAP (food stamps).
