I, like Chairman Meltzer, have worked with the Dover Amendment before, obviously in a different capacity as a municipal planning professional. I did take the opportunity, actually while I have been away, to revisit the seminal cases that have been cited—reading the legal briefs and also taking the opportunity to read the public comments that have come in. So, I also share Chairman Meltzer’s perspective. I’m not going to repeat everything that’s been said. Where I am landing at this moment is that the proposed staff housing is incidental to the educational use. I don’t believe that the two-prong test is failed at this point in time, and that the staff housing is a benefit—it’s not serving as the core primary educational use. So that is where I’m landing at the moment. And again, this is after revisiting the holdings of those seminal cases. I just don’t think that this proposed use is protected under the Dover Amendment.
