There must be a net increase of employees as a result of you have joined the business. For example, if the business had 10 employees when you joined them and this remains as 10, this will not be seen as a net increase of two employees. Instead, you will need to have 12 employees in the business at the time you apply for Indefinite leave to remain or your extension. What if I am a Part of an Entrepreneur Team? If you are part of an entrepreneur team, you do not need to evident more than two employees, however, you must be able to show that you are both directors in the same company and that you have invested the necessary funds. If you can do this, then you would both be able to rely on the same evidence and you would only need to show two employees rather than four. What is a Full-time Job Defined as? Traditionally, for most businesses, a full-time employee would be somebody that works for the company for about thirty (39) hours, often thirty-nine hours and a half (39.5), however for the purposes of the immigration rules, a full-time job is defined as being at least thirty (30) hours per week. If you employ somebody therefore for thirty-nine (39) hours per week and they remain an employee of your business for twelve (12) months, this would still be defined as one (1) full-time employee despite you have had them working for nine (9) extra hours per week. It is therefore important for you to understand this requirement before you begin to prepare for your extension so you don’t end up hiring somebody and having them work for longer hours than both the immigration rules require and your business requires. Who is a Settled Worker for the Purpose of the Job Creation Requirement? The Tier 1 Entrepreneur guidance states that for the purposes of this route, the following people will be considered settled workers. First of all, a British national, second of all, somebody that holds indefinite leave to remain also known as ILR or settlement, then we have British overseas territory citizens, commonwealth citizens who are allowed to enter or remain in the UK on the basis that a grandparent was born here. And finally, the EEA nationals, (note, however, that Swiss nationals not exercising treaty rights and Croatia nationals who require further authorisation are not included). What Evidence will I need to Provide to Satisfy the Job Creation Requirements? The evidence that you will need to provide will depend on the circumstances of your business. You will need to keep a complete record of which includes the following: 1. Real-time information, usually provided by your accountant known as RTI’s. 2. Payslips. 3. PAYE income tax records to HMRC 4. Documentation to show the employees' start date. 5. A record of the number of hours paid and hourly rates (which must meet the national minimum wage). 5. Proof to show that each employee meets the definition of a settled worker.
